Terms of Use

By downloading or using ChuckNote, you agree to these Terms of Use. If you don't agree, please don't use the app. These terms constitute a binding End-User License Agreement (EULA) between you and Carlos Ivan Silva ("we," "us," "our").

License grant

Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use ChuckNote for your personal, non-commercial purposes on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. This license does not include the right to sublicense, distribute, or resell the app.

Your content

Everything you write, draw, or attach in ChuckNote belongs to you. Your notes are stored locally on your device. We have no access to your content. You retain full ownership of all notes, drawings, and files you create or import within the app.

Prohibited uses

You may not use ChuckNote to:

• Store, transmit, or distribute content that is unlawful, infringing, defamatory, or otherwise objectionable.
• Reverse engineer, disassemble, decompile, or attempt to derive the source code of the app.
• Redistribute, sublicense, sell, rent, or lease the app or any portion of it.
• Use the app to develop a competing product or service.
• Use automated means (bots, scrapers, scripts) to access or interact with the app in a manner not intended by its design.
• Interfere with or circumvent any security or integrity feature of the app.

Intellectual property

ChuckNote, including its name, logo, mascot, design, code, and all related materials, is owned by Carlos Ivan Silva and is protected by applicable intellectual property laws. Nothing in these terms transfers any ownership of our intellectual property to you. The ChuckNote name and Chuck mascot may not be used without prior written permission.

Age restriction

ChuckNote is intended for users aged 13 and older. By using the app, you represent that you are at least 13 years of age. If you are under 13, please do not use ChuckNote.

No warranty

ChuckNote is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We make no guarantees that the app will be available, error-free, secure, or suitable for any particular purpose. Use it at your own risk.

Limitation of liability

To the fullest extent permitted by applicable law, Carlos Ivan Silva shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising from or related to your use of or inability to use ChuckNote, even if advised of the possibility of such damages. Our total liability for any claim arising out of these terms or your use of the app shall not exceed the amount you paid for the app (which, as a free app, is zero).

Data loss

Your notes are stored on-device. We strongly recommend enabling iCloud Backup on your device to protect against data loss. We are not responsible for data lost due to device failure, accidental deletion, operating system updates, or any other cause.

Termination

We reserve the right to discontinue ChuckNote or any feature of it at any time, with or without notice. Your license to use the app terminates automatically if you violate any of these terms. Upon termination, you must stop using the app and delete it from your devices. Sections covering intellectual property, warranty disclaimers, limitation of liability, and governing law will survive termination.

Third-party services

ChuckNote may open links in your device's browser (for example, when you use the word-lookup feature). Those external sites and services are governed by their own terms and privacy policies, which we do not control and are not responsible for.

Changes

We may update these terms from time to time. We will update the date at the top of this page when we do. Continued use of the app after changes constitutes acceptance of the updated terms.

Governing law

These terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict-of-law provisions. Any disputes arising under these terms shall be resolved in the courts of Texas.

Accessibility

We are committed to making ChuckNote accessible to all users. ChuckNote is built on Apple's UIKit and SwiftUI frameworks, which include built-in support for VoiceOver, Dynamic Type, and other iOS accessibility features. If you encounter an accessibility barrier or have a request related to accessibility, please contact us at chuckchuckapps@gmail.com and we will do our best to address it promptly.
